CCPA Privacy Notice

1. What this notice covers

This notice is for California residents and supplements our Privacy Policy at /privacy-policy. It describes your rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). If there is any conflict between this notice and the Privacy Policy, this notice controls for California residents.

2. Personal information we collect

In the past 12 months we have collected the following categories of personal information:

• Identifiers: name, email address, IP address, account username.
• Commercial information: subscription plan, billing history, credits consumed.
• Internet or network activity: pages visited, features used, browser and device type.
• Geolocation data: approximate location derived from IP address.
• User-generated content: prompts, project files, code, and designs you create.
• Inferences: usage patterns drawn from the above to improve the product.

3. How we use personal information

We use the categories above to provide and improve the service, process payments, communicate with you, prevent fraud and abuse, comply with legal obligations, and — using aggregated, de-identified data — improve our AI prompts and agent reliability. See our Privacy Policy for full details.

4. Sharing of personal information

We share personal information with service providers (cloud hosting, payment processors, analytics, AI model providers) acting on our behalf under written contracts. We do not sell personal information and have not done so in the past 12 months. We do not share personal information for cross-context behavioral advertising.

5. Your California rights

As a California resident you have the following rights:

• Right to Know: Request the specific pieces and categories of personal information we have collected about you in the past 12 months, the sources, our purposes, and the categories of third parties with whom we share it.
• Right to Delete: Request deletion of personal information we have collected, subject to exceptions (e.g. completing a transaction, legal compliance, security).
• Right to Correct: Request correction of inaccurate personal information.
• Right to Opt Out of Sale/Sharing: We do not sell or share personal information for advertising. No action required.
• Right to Limit Use of Sensitive Personal Information: We do not use sensitive personal information beyond what is necessary to provide the service.
• Right to Non-Discrimination: Exercising your rights will not result in denial of service or different pricing.

6. How to submit a request

Email [email protected] with the subject line "California Privacy Request" and describe the right(s) you wish to exercise. You may submit requests up to twice per 12-month period.

We will acknowledge your request within 10 business days and respond substantively within 45 days. If we need more time (up to an additional 45 days), we will notify you.

We will verify your identity before fulfilling requests that involve disclosing or deleting data. Verification requires confirming your email address and, for sensitive requests, additional factors.

7. Do Not Sell or Share My Personal Information

Vibely does not sell personal information and does not share it for cross-context behavioral advertising. You do not need to opt out. If this practice changes, we will update this notice and provide a clear opt-out mechanism.

8. Do Not Track

Some browsers transmit "Do Not Track" signals. We do not currently alter our data practices in response to these signals because no uniform standard has been established. California law requires us to disclose this practice.

9. Minors

Vibely does not knowingly collect personal information from persons under 18. If you believe we have inadvertently collected such data, contact [email protected] and we will delete it.

10. Changes to this notice

We may update this notice to reflect changes in our practices or the law. Material changes will be communicated via email or in-product notice.
