We ship features before they are finished, and we label them when we do. This page is what you are agreeing to when you use one: no warranty, no service commitment, it can vanish without notice, and the Credits it spends are gone.
"Beta Feature" means any feature, model, connector or template Vibely makes available and identifies as alpha, beta, preview, early access or experimental; a Beta Feature is provided as-is, may change or be withdrawn without notice, is excluded from any service commitment, and consumes Credits like any other work.
If it carries one of those labels, this page applies to it. If it does not, it is an ordinary part of the Service and these terms do not apply.
Everything in our Terms of Service at /terms-of-service still applies when you use a Beta Feature — the same account obligations, the same Acceptable Use Policy, the same billing, the same limitation of liability, the same governing law. This page adds to those Terms for Beta Features and does not replace them. Where this page and the Terms conflict on a Beta Feature, this page wins for that feature.
A Beta Feature is unfinished. Expect wrong output, broken builds, lost work, sudden slowness, and behaviour that changes between one day and the next. Do not put a Beta Feature on the critical path of anything you cannot afford to have fail.
Quoting the Terms, which apply here without qualification: the service is provided "as is" without warranties of any kind. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by applicable law.
Our Service Level Agreement at /sla expressly excludes Beta Features, so a Beta Feature carries no uptime commitment, no support response time, no availability target, and no service credit or other remedy for downtime. Support for a Beta Feature is best effort.
We may change how a Beta Feature works, restrict who can use it, or remove it entirely, at any time and without telling you first. That can happen in the middle of a project.
The Terms promise at least 14 days’ notice of material changes to the Terms themselves. That is a notice period for the contract, not for whether a Beta Feature keeps existing. A Beta Feature may also never ship: nothing here commits us to releasing one generally, on any timetable, on any plan, or at any price.
A Beta Feature consumes Credits like any other work. A turn is charged for the tokens it actually used, priced by the model selected, subject to a small per-turn minimum.
Credits you spend in a Beta Feature are not returned — not for output you did not like, not for a turn that failed, and not because we later changed or withdrew the feature. “Refunds and cancellation” in the Terms of Service at /terms-of-service applies unchanged, including the narrow cases where a refund is due.
Where we give you a Beta Feature that we have not announced publicly, the feature, how it works, what it is called and anything we tell you about it are our Confidential Information under the confidentiality section of the Terms. Do not post screenshots, demos, benchmarks, write-ups or the feature name until we have announced it. Once we announce it publicly, this restriction ends for what we announced.
The standard exceptions in the Terms still apply, including information that becomes public through no fault of yours and disclosure you are legally compelled to make.
What you build is not covered by this. Your Project, its source code and its Generated Output are Customer Content and remain yours to publish, ship and talk about.
Send us feedback on a Beta Feature and you give Vibely a worldwide, perpetual, irrevocable, royalty-free licence to use it for any purpose, including building it into the product and shipping it to everyone, with no obligation to credit you, compensate you, keep it confidential or act on it at all.
So do not send us anything you consider confidential, anything covered by someone else’s NDA, or anything you do not have the right to give us. Feedback is your comments about the feature — it does not include your Project source or your Generated Output, which stay yours.
Data that exists only inside a Beta Feature — its settings, its history, whatever it stored for you — may be deleted when the feature changes, graduates to general release, or is withdrawn. We are not obliged to migrate it, convert it, or hand it back, and there may be no export path. If it matters to you, export it or copy it into your Project while the feature is still there.
Your Project itself is not affected by this. Its source, versions and history live in the Project and follow the normal retention rules in the Privacy Policy at /privacy-policy.
Not using a Beta Feature is the opt-out. We label them, and nothing makes you pick one — choose the stable model, connector or template instead and none of this page applies to you.
Where a Beta Feature has its own on or off switch, it is on the feature itself, and turning it off takes effect immediately.
If a Beta Feature is on by default and you want it off across your workspace, email [email protected] from the address on the account with the workspace name and the feature. Opting out does not refund Credits already spent.
The limitation of liability in the Terms applies to Beta Features in full, quoted here so it is not a surprise: "The aggregate liability of Mana Intelligence Private Limited — us, the company that operates Vibely — arising out of or relating to the service will not exceed the greater of (a) the amounts you paid us in the 6 months before the date the claim first arose, or (b) USD 100."
And: "To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility."
Quoting the Terms: "These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts at Hyderabad, Rangareddy district, Telangana, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service, and both of us submit to that jurisdiction."
