Do Not Sell or Share My Personal Information

The California opt-out page. We do not sell personal information and we do not share it for cross-context behavioural advertising — this page explains what those words mean, why our analytics do not meet either definition, and how to switch them off anyway.

1. The short answer

Vibely does not sell personal information, and has never sold it. We do not share personal information for cross-context behavioural advertising. There is no advertising business here to opt out of: we run no ad platforms, no retargeting pixels, and no cross-site trackers. What you can opt out of is our analytics, and you can do that in one click — see "How to opt out anyway" below.

2. What "sell" and "share" mean here

Under the CCPA, as amended by the CPRA, "sell" means disclosing personal information to a third party for money or other valuable consideration. "Share" is narrower and catches something specific: disclosing personal information to a third party for cross-context behavioural advertising — targeting you with ads based on your activity across sites and apps you did not choose to be tracked across.

Neither word turns on whether a third party is involved. Both turn on what the third party is allowed to do with the data. A service provider that processes data only on our instruction, under a contract that forbids it from using that data for its own purposes, is not a sale or a share.

3. Do our analytics count as sharing? No — and here is why

This is the part most opt-out pages skip. Our answer, with the specifics:

  • PostHog is our product analytics. Once you are signed in it associates your events with your account id and your email address, and in production it records interaction heatmaps and session replays of your use of the Vibely app. That data is used to make Vibely work better. It is not used to target advertising, on our sites or anyone else's.
  • Google Analytics 4 and Google Tag Manager run on our marketing pages. In our tag configuration the advertising storage, ad user data, ad personalisation and personalisation storage signals are pinned to denied. They are not wired to the consent banner, so they stay denied even if you accept everything. That is the setting that would otherwise turn GA4 into an advertising share, and it is off in code.
  • Cloudflare Web Analytics is a cookieless beacon. It sets no cookies, stores nothing on your device, and does not identify you.
  • Sentry receives crash reports with your account id attached, so we can reach you about a bug you hit.
  • We build no advertising audiences, run no retargeting, and pass nothing to an ad network. So: our analytics are a disclosure to service providers, not a sale and not a share.

4. How to opt out anyway

You do not need a legal right to switch our analytics off. Use whichever of these suits you:

  • Click "Cookie preferences" in the footer of any page and decline. It applies immediately, you do not need an account, and you do not need to be signed in.
  • Block or clear cookies in your browser. Vibely will keep working; only analytics stop.
  • Email [email protected] with the subject line "California Privacy Request" and tell us what you want stopped. We acknowledge within 10 business days and respond substantively within 45 days, and will tell you if we need the further 45 days the law allows.
  • Exercising any of this costs nothing and changes nothing about your plan, your price, or the service you get.

5. Global Privacy Control

The Global Privacy Control is a signal your browser or extension sends to say "treat this as an opt-out of sale and sharing". Under California law a business that sells or shares personal information has to honour it.

Vibely does not sell or share personal information, so there is nothing for the signal to switch off, and we do not currently read it as a separate signal. Our analytics are opt-in regardless: if you never accept the banner, nothing is measured. If we ever start selling or sharing personal information as those terms are defined above, we will honour the Global Privacy Control as an opt-out and we will say so on this page before we do it.

6. Someone acting on your behalf

An authorised agent can make a request for you. Email [email protected] from the agent's own address, attach your written permission, and we will confirm directly with you before we act. We verify the request the same way we verify your own: control of the email address on the account, plus one more factor for a deletion or a full copy of your data.

7. Sensitive personal information

We do not use or disclose sensitive personal information for any purpose beyond what is necessary to provide the service you asked for — which means, in practice, authenticating you and processing your payments. We do not infer characteristics from it, and there is nothing here for the "limit the use of my sensitive personal information" right to restrict.

8. People under 16

Vibely is not for anyone under 18, so we do not knowingly hold personal information about anyone under 16 and could not sell or share it if we wanted to. If you believe we have collected data about a minor, email [email protected] and we will delete it.

9. Your other California rights

The rights to know, delete, correct, and not be discriminated against for using any of them are set out in full under “California residents (CCPA and CPRA)” in our Privacy Policy at /privacy-policy, along with the underlying detail — what we collect, why, and for how long.
