Trademark counter-notice
We acted on a trademark complaint about your app or project and you believe the use was lawful. Set out why. We confirm receipt within 1 business day and decide within 10 business days, and a person reviews it — not the system that made the original decision. If the takedown was about copied code, text, or images rather than a brand, use /abuse/dmca-counter instead.
This counter-notice is not confidential
We send it in full — including your name, your email address, and the contact details in it — to the person who complained. That is the same deal they got: their complaint, and their identity, was passed to you. Neither side of a trademark dispute argues anonymously.
The confidentiality we offer on the general abuse report at /abuse/report does not apply here.
Your basis for the use
Name the one that fits — more than one can — and give the evidence for it in the message.
Licence or permission
You have the mark holder’s permission. Give the licence date, its scope, and who granted it. Attach or quote the clause if you can.
Nominative fair use
You name their product to refer to it — "works with", "imports from", a comparison, an integration. Say what you use, that you use no more of the mark than you need, and that nothing on the page suggests they endorse you.
Descriptive use
The word is being used for its ordinary meaning, not as a brand. Say what it describes and point at the wording that makes that plain.
Prior or independent rights
You registered first, used it in trade first, or the complainant has no rights in your territory or your class of goods. Give your registration number and jurisdiction, or the date and evidence of first use.
Also include what was removed and the URL where it appeared, and your contact details — a postal address and a telephone number as well as the email you give above. The complainant is entitled to them, and a counter-notice without them is not one we can forward.
